New Brunswick Court of Appeal refuses to overturn injunction


Rogers fails in their attempt to appeal earlier injunction ruling


FREDERICTON, June 15 2010 -- Today, in the Court of Appeal in Fredericton, New Brunswick, Justice
Joseph T. Robertson
denied Rogers' attempt to appeal an earlier decision that granted Bell Aliant an
injunction that stops them from claiming to have the 'fastest and most reliable' high speed Internet product.


"We are very pleased that the judge has refused to overturn
this injunction," says Karen Sheriff, president and CEO, Bell
Aliant. "It reinforces our strong belief that our competitors
should not be permitted to use false and misleading advertising."

On May 4, 2010, the Court of the Queen's Bench in Fredericton granted Bell Aliant an injunction to stop
Rogers Communications Inc. from claiming to have the 'fastest and most reliable' high speed Internet
product. In her decision, Justice Clendening ordered Rogers to stop claiming to have the "fastest speed,"
"most reliable speed," or "fastest and most reliable speed".
